Kids Liability Waiver

For participants under 18. Every participant under 18 must have this waiver signed by a parent or legal guardian before taking part in any Norcal Athletics program. Participants 18 and over use the Adult Liability Waiver instead.

Programs operated by our partner organizations at Norcal-permitted sites are covered by this waiver.


Release of Liability, Assumption of Risk, and Indemnification Agreement — for a participant under 18 years of age.

1. Activity and risks

I allow my minor child ("the Minor") to take part in Norcal Athletics programs, open gym, leagues, clinics, tournaments and related events and activities (the "Activity"), organized by Norcal Athletics ("NORCAL"). I understand the Activity is inherently hazardous and that the Minor may be exposed to dangers including falls, fractures, concussions, overexertion, overheating, and other injuries arising from the Minor's lack of fitness or conditioning, the Minor's own actions or inactions, equipment failure, or the negligence of others, and that as a consequence the Minor may be seriously injured or disabled or may die. In consideration of the Minor being permitted to take part in any way in the Activity, I agree to the terms below.

2. Assumption of risk

I freely assume those risks and any harm, injury or loss to the Minor, to me, or to my property arising from the Minor's participation in the Activity or from transportation to or from it, including any injury or loss caused by the negligence of NORCAL, its officers, employees and contractors, or of other people. Any equipment the Minor brings or borrows is used at the Minor's own risk and without warranty as to its condition or suitability.

3. Release of liability

I hereby RELEASE the Released Parties FROM ALL LIABILITIES, CAUSES OF ACTION, CLAIMS AND DEMANDS arising in any way from any injury, death, loss or harm to the Minor, to any other person, or to any property during the Activity or in any way related to it, including during transportation to or from it. "Released Parties" means:

  • NORCAL and its board, officers, directors, employees, volunteers and contractors;
  • San Francisco Unified School District, its Board, officers, agents and employees, and any other entity that permits, leases or otherwise makes facilities available to NORCAL for the Activity, together with their respective officers, agents, employees and volunteers;
  • any partner program operator whose program the Minor takes part in through NORCAL, together with its coaches, instructors, staff, contractors and volunteers; and
  • the providers of any equipment used in the Activity.

This release covers claims for the Released Parties' own negligence and claims for strict liability for abnormally dangerous activities. It does not extend to gross negligence, intentional or reckless misconduct, or any other liability that California law does not permit to be released.

4. Indemnification, hold harmless and defense

I will INDEMNIFY, HOLD HARMLESS AND DEFEND the Released Parties against all claims to which Section 3 applies, including claims for their own negligence, and against all claims arising from the Minor's negligence or the Minor's conduct during the Activity, and I will reimburse them for damages, reasonable settlements and defense costs, including attorney's fees. In the event of my death or disability these obligations bind my estate and my personal representative, executor, administrator or guardian.

5. Fitness and medical consent

It is my sole responsibility to know the physical and mental demands of the Activity. To my knowledge the Minor has no physical or medical condition that would endanger the Minor or others, or interfere with the Minor's participation, except as disclosed at registration. NORCAL has made no investigation of the Minor's fitness and relies solely on this warranty. I consent to leaders of the Activity administering general first aid to the Minor and, if an injury or illness is life threatening or needs emergency treatment and I or another legal guardian cannot be reached, to their summoning professional emergency personnel to attend, transport and treat the Minor. NORCAL assumes no responsibility for any injury, damage or expense arising from such treatment.

6. Use of likeness

The Minor may be photographed or filmed during the Activity. To the fullest extent allowed by law I waive the Minor's rights of publicity, privacy and pre-approval in any such likeness and in the use of the Minor's name with it, and I grant NORCAL and its assigns permission to copyright, use and publish it, in whole or in part, in any form and for any purpose. Parents who do not wish to grant this permission may decline on the signed form; declining does not affect the Minor's participation, and the rest of this agreement still applies.

7. Other terms

This agreement is intended to be an enforceable release and indemnity as broad and inclusive as California law permits. If any provision is found invalid or unenforceable, the remainder continues in full force and that provision will be modified or partially enforced to the maximum extent permitted. California law governs, without reference to choice of law rules. Any dispute arising from this agreement or in any way associated with the Activity shall be brought only in the San Francisco Superior Court, to whose jurisdiction and venue I consent. In any litigation contesting the validity or enforceability of this agreement, the non-prevailing party will pay the prevailing parties' attorney's fees and costs.

8. Acknowledgment

I am the parent or legal guardian of the Minor and have authority to sign this agreement on the Minor's behalf. The Minor is registered with NORCAL for the Activity, and this agreement applies to every session of the Activity during the program or season named on the signed form. I have read this entire agreement before signing it. No oral representations, statements or other inducements to sign have been made apart from what it contains.
